1. Payment Terms
Payment is required within 14 days from the date of the invoice. TRIHOUSE MEDIA reserves the right to apply a late fee for overdue payments. Should TRIHOUSE MEDIA introduce or amend late fees, clients will be notified in writing prior to the change.
2. Payment Methods & Surcharges
Payments can be made via direct deposit or card. Please note that any surcharges or transfer fees incurred for payments made via card or other online methods will be passed on to the client. The client agrees to pay any additional fees associated with their chosen payment method.
3. Refunds & Price Adjustments
Refunds are not provided except as required under Australian Consumer Law. Due to the nature of services provided, which primarily involve labour and installation of networking equipment, all sales are final once work is completed.
Equipment prices are subject to change due to market fluctuations. TRIHOUSE MEDIA reserves the right to adjust prices by up to 20% in response to significant market shifts. Clients will be notified in writing of any price adjustments prior to procurement, and work will proceed only upon client approval. Delivery costs will be calculated based on actual delivery fees from vendors and may vary depending on the number of vendors used.
4. Delivery, Travel & Installation Charges
Delivery costs are not included in the initial quote and will be invoiced separately based on actual costs incurred from vendors. Travel costs will apply to work conducted outside Metro Melbourne. Travel is charged at $0.87 per kilometre, in addition to a daily rate for travel time. The daily rate and travel costs will be discussed and agreed upon with the client prior to commencement of work.
5. Disputes & Payment Flexibility
TRIHOUSE MEDIA is committed to working flexibly with clients regarding pricing discussions before work begins. Once services are completed, the client agrees to honour the agreed-upon pricing as outlined in the invoice. In cases of financial hardship, TRIHOUSE MEDIA may offer payment plans on a case-by-case basis to accommodate the client’s situation.
In the event of a dispute, both parties agree to attempt resolution through good-faith negotiation. Should negotiations fail, the matter will be referred to mediation prior to any legal proceedings.
6. Confidentiality
TRIHOUSE MEDIA acknowledges the importance of maintaining confidentiality, particularly when operating in sensitive environments such as law firms and corporate offices. All work conducted in such spaces will be treated with the utmost discretion, and TRIHOUSE MEDIA agrees to safeguard all confidential and proprietary information obtained during the course of service.
7. Liability and Insurance Disclaimer
TRIHOUSE MEDIA does not carry public liability insurance. By engaging TRIHOUSE MEDIA’s services, the client acknowledges and accepts full responsibility for any risks or liabilities arising from the services provided. The client and their insurers assume full liability for any claims, losses, or damages resulting from the services rendered.
TRIHOUSE MEDIA’s total liability, if any, will be limited to the amount paid for the services provided, except as required under Australian law. TRIHOUSE MEDIA is not liable for indirect or consequential losses, including but not limited to loss of profits, data, or business interruption.
8. Force Majeure
TRIHOUSE MEDIA shall not be liable for any delays or failure to perform its obligations due to events beyond its reasonable control, including but not limited to natural disasters, acts of terrorism, strikes, pandemics, or government regulations. In such cases, TRIHOUSE MEDIA will communicate with the client to discuss rescheduling or cancellation of services.
9. Governing Law
These Terms & Conditions are governed by the laws of Victoria, Australia. Any disputes arising out of or relating to these Terms & Conditions shall be subject to the exclusive jurisdiction of the courts of Victoria.
Acceptance of Terms & Conditions
By engaging TRIHOUSE MEDIA’s services, the client agrees to the Terms & Conditions outlined above. These Terms & Conditions are available on all quotes, invoices, and upon request.
